Description: <DIV STYLE="text-align:Left;"><DIV><DIV><P><SPAN>The Chesapeake Bay and its tributaries constitute an important and productive estuarine system, providing economic and social benefits to the citizens of the City of Norfolk and the Commonwealth of Virginia. The health of the Chesapeake Bay is vital to maintaining the city's economy and the welfare of its citizens. The intent of the city and the purposes of the Overlay District are to: (1) protect existing high quality state waters; (2) restore all other state waters to a condition or quality that will permit all reasonable public uses and will support the propagation and growth of all aquatic life, including game fish, which might reasonably be expected to inhabit them; (3) safeguard the clean waters of the Commonwealth from pollution; (4) prevent any increase in pollution; (5) reduce existing pollution; and (6) promote water resource conservation in order to provide for the health, safety, and welfare of the present and future citizens of the city.</SPAN></P></DIV></DIV></DIV>

Description: <DIV STYLE="text-align:Left;"><DIV><P><SPAN>Conditional zoning is the granting of a zoning change by a governing body which is subject to agreed upon specific conditions which limit permitted uses in a zoning district. Lands rezoned to a conditional zoning district shall be subject to the proffered conditions offered by the applicant and accepted by the City Council. These standards and modifying conditions are binding on the land as an amendment to this Ordinance and the Official Zoning Map.</SPAN></P></DIV></DIV>

Description: <DIV STYLE="text-align:Left;"><DIV><DIV><P><SPAN>A use designated as a conditional use in a particular zoning district is a use that may be appropriate in the district, but because of its nature, extent, and external effects, requires special consideration of its location, design, and methods of operation before it can be deemed appropriate in the district and compatible with its surroundings. The purpose of this section is to identify the appropriate review procedure and other special standards for reviewing conditional uses to ensure they are appropriate for a particular zoning district. Conditional Use Permit was called a special exception in the prior zoning ordinance, “Zoning Ordinance of the City of Norfolk, 1992,” as originally adopted on March 3, 1992, and subsequently amended.</SPAN></P></DIV></DIV></DIV>
